Overview: Caltha provided expert environmental review support to this distribution firm to evaluate environmental risks potentially associated with the acquisition of a property located near the Fargo / Moorhead area of western Minnesota. Caltha first conducted a Phase 1 environmental site assessment in accordance with ASTM E 1527-05. This assessment revealed that the site had previously been used for the formulation of fertilizer products. A Phase 2 investigation was then conducted which determined that contamination due to the former fertilizer manufacturing processes had occurred. The prospective Buyer was able to get the Seller to conduct further investigations required by the State of Minnesota. The prospective Buyer was also able to obtain liability protections through the MPCA Voluntary Investigation & Cleanup (VIC) program, through a “No Association” determination.
