The benefits of infiltration include reducing overall run-off volume, reducing stormwater and channel run-off rates, and reducing pollutant loading.&lt;br /&gt;&lt;br /&gt;However, infiltration can also create other issues, including groundwater contamination. Infiltration of stormwater (and the wastes it carries) may also invoke other environmental regulations.&lt;br /&gt;&lt;br /&gt;The Minnesota Pollution Control Agency has incorporated requirements for the use of both &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;infiltration devices&lt;/span&gt;&lt;/strong&gt; and &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;stormwater ponds&lt;/span&gt;&lt;/strong&gt; used to manage industrial site runoff. These requirements include:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;1. Industrial stormwater ponds and infiltration devices located in areas where high levels of contaminants exist in the soil or in the shallow aquifer, must not contribute to contaminant(s) spreading to a greater extent or rate. At any contamination site, a site analysis shall be conducted and a report filed with the SWPPP.&lt;br /&gt;&lt;br /&gt;&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;a. If industrial stormwater ponds and infiltration devices are found to be a contributor to contaminant increase or movement, the site must submit a plan to MPCA that describes how they will be reducing contaminants, redesigning, relocating, or eliminating the industrial stormwater ponds and infiltration devices, as needed, to eliminate the contribution to contaminant problems.&lt;br /&gt;&lt;/span&gt;&lt;/em&gt;&lt;br /&gt;2. Industrial stormwater ponds and infiltration devices can not be used in any high risk karst area unless a professional geotechnical evaluation is conducted to ensure that they do not present a significant risk to groundwater.&lt;br /&gt;&lt;br /&gt;&lt;/strong&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;a. If the industrial stormwater ponds and infiltration devices present a risk, appropriate measures, such as sealing or removal of the industrial stormwater ponds or infiltration devices, must be taken to eliminate or minimize the risk. Evaluations shall be documented with the SWPPP.&lt;/span&gt;&lt;br /&gt;&lt;br /&gt;&lt;/em&gt;3. Use of industrial stormwater ponds and infiltration devices in vulnerable wellhead protection areas must be coordinated with local drinking water authorities and shall be designed to not adversely affect drinking water supplies. The facility must contact the appropriate local drinking water authorities and document coordination efforts with the SWPPP.&lt;br /&gt;&lt;br /&gt;4. Facilities using any infiltration device defined as a “Class V injection well” shall contact the US EPA Region HQ to determine the need to register as a “Class V injection well”. The revised permit will replace the current permit that was issued in 1997. The revised permit represents a significant departure from compliance requirements Minnesota industrial and “industrial-like” facilities have had.&lt;br /&gt;&lt;br /&gt;MPCA’s tentative schedule is to present findings on the revised permit to Citizens’ Board and request Board approval of permit on March 23, 2010. Assuming that the permit is approved, MPCA anticipates the final permit with be &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;effective April 1, 2010.&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;All facilities subject to the stormwater rules must submit an application for coverage under the revised permit, even if already covered under the expired permit. Existing facilities must have &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;prepared and implemented a new SWPPP and be in compliance with the new permit before they apply for permit coverage&lt;/span&gt;&lt;/strong&gt;. New facilities must submit applications at least 180-days before beginning construction or operation.&lt;br /&gt;&lt;br /&gt;Because of the volume of applications that MPCA expects to receive, the due date for applications is staggered over six months. This permit, once promulgated, will replace the existing industrial stormwater permit, which expired in 2005.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.calthacompany.com/blog/2010/02/arizona-adeq-draft-industrial-multi.html"&gt;Review a summary of the ADEQ Industrial Stormwater Permit&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Some key changes in the proposed permit are the additional requirements for 30 different sector specific requirements. The requirements described are proposed for the &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Paper and Allied Products Manufacturing Sector (Sector B)&lt;/span&gt;&lt;span style="color:#000000;"&gt;.&lt;/span&gt;&lt;/strong&gt; Sector B covers a fairly broad range of facility types, including paperboard mills, pulp mills, paper mills, paperboard containers and boxes, converted paper and paperboard products. These requirements are &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;in addition to permit requirements that apply to all sectors&lt;/span&gt;&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Monitoring Benchmarks:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;Some facilities are required to conduct both visual and chemical (benchmark) monitoring. This permit, once promulgated, will replace the existing industrial stormwater permit, which expired in 2005.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.calthacompany.com/blog/2010/02/arizona-adeq-draft-industrial-multi.html"&gt;Review a summary of the ADEQ Industrial Stormwater Permit&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;Some key changes in the proposed permit are the additional requirements for 30 different sector specific requirements. The requirements described are proposed for the &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Food and Kindred Products Sector (Sector U)&lt;/span&gt;&lt;span style="color:#000000;"&gt;.&lt;/span&gt;&lt;/strong&gt; Sector U covers a fairly broad range of facility types, including meat products, dairy products, bakeries, beverage products, and many others. What Kind of Training is Required?&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The answer will depend on the State your facility is located in – different States will have different training requirements. However, Caltha generally sees three categories for training:&lt;br /&gt;&lt;span style="color:#ff9900;"&gt;a) SWPPP Awareness Training.&lt;/span&gt; This is “high-level” training which may be given to all employees, and covers basics of  stormwater program and facility controls that would apply to any employee.&lt;br /&gt;&lt;span style="color:#ff9900;"&gt;b) Stormwater Training.&lt;/span&gt; This training would be addressing employees whose day-to-day work activities relate to the specific  controls and procedures the facility has established in its SWPPP, such as dock workers who might be involved with spills.&lt;br /&gt;&lt;span style="color:#ff9900;"&gt;c) Stormwater Permit Compliance Training.&lt;/span&gt; Employees who have been assigned specific compliance tasks, such as conducting  inspections, collecting stormwater samples, need to be trained to conduct their tasks.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;2. Can I Use Generic Training Materials?&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Many good training resources are available, including video training and  “on-line” courses. Caltha often recommends these resources as a element of a facility’s training program. Whether or not these types of “off-the-shelf” training resources meet the training requirements will depend on the specific requirements for your State. In many cases, training needs to include information on the facility SWPPP, and therefore the “off-the shelf” resources need to be augmented with facility-specific training.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;3. Does Every Employee Need to be Trained?&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Possibly. However, as described in #1 above, not all employees need to have the same level of training. In addition, other factors, such as ISO 14001 registration, may require that you consider training contractors working at your facility.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;4. How Often Does Training Need to be Presented? &lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Many States require annual refresher training;  however, some training might only be presented once, such as Permit Compliance Training.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;5. Does Stormwater Training Need to be Documented?&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Yes, because training is a requirement of an NPDES discharge permit, records need to be maintained to demonstrate that all affected employees received the appropriate training.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;6. Do Our Trainers Need Special Training?&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;This is not addressed in most States; however, effective trainers need to understand their subject matter. These requirements are &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;in addition to permit requirements that apply to all sectors&lt;/span&gt;&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Inspections:&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The facility must conduct inspections addressing areas associated with spent solvents, chemical storage areas, and outdoor paint areas.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Good Housekeeping:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The pollution prevention program must implement measures for controlling or recovering scrap metals, fines, and metal dust. The SWPPP must include measures for containing materials within storage handling areas. The SWPPP must describe and implement measures for storage of metal working fluids.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Leaks and Spills:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The spill prevention program must address chromium, toluene, pickle liquor, sulfuric acid, zinc and other water priority chemicals, and hazardous chemicals and wastes.&lt;br /&gt;&lt;br /&gt;The spill prevention plan must describe and implement measures to control and clean up spills of solvents and other liquid cleaners, control sand buildup and disbursement from sand-blasting operations, and prevent exposure of recyclable wastes including rinse waters. This permit, once promulgated, will replace the existing industrial stormwater permit, which expired in 2005.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.calthacompany.com/blog/2010/02/arizona-adeq-draft-industrial-multi.html"&gt;Review a summary of the ADEQ Industrial Stormwater Permit&lt;br /&gt;&lt;/a&gt;&lt;br /&gt;The proposed permit details requirements for 30 different industrial sectors. The requirements described below are proposed for the &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Automobile Salvage Yards Sector (Sector M)&lt;/span&gt;&lt;span style="color:#000000;"&gt;.&lt;/span&gt;&lt;/strong&gt; Sector M includes sites primarily engaged in the dismantling or wrecking used motor vehicles for parts recycling or resale and scrap. These requirements are &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;in addition to permit requirements that apply to all sectors&lt;/span&gt;&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Employee Training:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The SWPPP must address the following areas in the employee training program: proper handling (collection, storage, and disposal) of oil, used mineral spirits, anti-freeze, mercury switches, freon, and solvents.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Good Housekeeping:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The SWPPP must include to the maximum extent feasible:&lt;br /&gt;1) store all batteries indoors;&lt;br /&gt;2) recycle lead battery cable ends and wheel balancing weights;&lt;br /&gt;3) remove all fluids from vehicles and recycle or dispose accordingly;&lt;br /&gt;4) remove and segregate mercury switches and mercury containing devices;&lt;br /&gt;5) recycle fuels,&lt;br /&gt;6) remove and dispose of freon as required with complete avoidance of venting to atmosphere;&lt;br /&gt;7) remove and dispose of glycols as required;&lt;br /&gt;8) remove and recycle all lead parts;&lt;br /&gt;9) separate and recycle, if feasible, plastics or dispose as solid waste;&lt;br /&gt;10) store all engines and transmissions (that have been removed from vehicles) in covered areas not exposed to precipitation.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Inspections:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The site must immediately inspect vehicles arriving at the facility for leaks. The site must be inspected quarterly for signs of leakage, all equipment containing oily parts, hydraulic fluids, any other types of fluids, or mercury switches; and also inspect all vessels and areas where hazardous materials and general automotive fluids are stored, including mercury switches, brake fluid, transmission fluid, freon, and antifreeze.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Controls:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;Each site must implement the following management practices: berms or drainage ditches on the property line (to help prevent run-on from neighboring properties); installation of detention ponds; installation of filtering devices such as sand filter or mixed media filters, and oil and water separators. Engines and transmissions, and similar oily parts shall be stored in covered areas or, at a minimum, be covered with impermeable tarps or similar material to eliminate contact with stormwater; and above ground liquid storage tanks must have secondary containment.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Monitoring Benchmarks:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;All facilities are required to conduct visual and chemical (benchmark) monitoring. The requirements described below are proposed for the &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Primary Metals Sector (Sector F)&lt;/span&gt;&lt;span style="color:#000000;"&gt;.&lt;/span&gt;&lt;/strong&gt; Sector F covers a fairly broad range of facility types, including steel works, blast furnaces, and rolling and finishing mills, iron and steel foundries, primary smelting and refining of nonferrous metals, secondary smelting and refining of nonferrous metals, rolling, drawing, and extruding of nonferrous metals, nonferrous foundries and other primary metal products These requirements are &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;in addition to permit requirements that apply to all sectors&lt;/span&gt;&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Inspections:&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The facility must conduct inspections addressing air pollution control equipment (e.g., baghouses, electrostatic precipitators, scrubbers, and cyclones) for any signs of degradation (e.g., leaks, corrosion, or improper operation) that could limit their efficiency and lead to excessive emissions. The operation must monitor air flow at inlets and outlets (or use equivalent measures) to check for leaks (e.g., particulate deposition) or blockage in ducts. Also inspect all process and material handling equipment (e.g., conveyors, cranes, and vehicles) for leaks, drips, or the potential loss of material.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Good Housekeeping:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;Good housekeeping practices must include a cleaning and maintenance program for all impervious areas of the facility where particulate matter, dust, or debris may accumulate, especially areas where material loading and unloading, storage, handling, and processing occur. The operation must also implement a cleaning program which includes regular sweeping for the paving of areas where vehicle traffic or material storage occur but where vegetative or other stabilization methods are not practicable. For unstabilized areas where sweeping is not practicable, the operation must select an alternative stormwater management devices that effectively trap or remove sediment.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Monitoring Benchmarks:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;All facilities are required to conduct visual and chemical (benchmark) monitoring. The requirements described below are proposed for the &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Glass, Clay, Cement, Concrete, and Gypsum Products Sector (Sector E)&lt;/span&gt;&lt;span style="color:#000000;"&gt;.&lt;/span&gt;&lt;/strong&gt; Sector E covers a fairly broad range of product types, including flat glass, glass containers, pressed and blown glass, hydraulic cement, structural clay products, pottery and related products, concrete, gypsum, and plaster products, glass products, cut stone and stone products, abrasives, asbestos products, and miscellaneous non metal mineral products, mineral wool and mineral wool insulation products, and non-clay refractories. These requirements are &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;in addition to permit requirements that apply to all sectors&lt;/span&gt;&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Inspections:&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The facility must conduct inspections of dust collection and containment systems.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Good Housekeeping:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The facility must prevent or minimize the discharge of spilled cement, aggregate (including sand or gravel), kiln dust, fly ash, or settled dust from paved portions of the facility that are exposed to stormwater. Each facility must determine the frequency of sweeping or equivalent by the amount of industrial activity occurring in the area and the frequency of exposure to stormwater, but it must be performed at least once a week, if cement, aggregate, kiln dust, fly ash, or settled dust are being handled or processed. The operation must also prevent the exposure of fine granular solids (cement, fly ash, kiln dust, etc.) to stormwater.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Certification:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;For facilities producing ready-mix concrete, concrete block, brick, or similar products preventive measures must certify that process wastewater resulting from washing trucks, mixers, transport buckets, forms, or other equipment are discharged in accordance with a separate applicable NPDES permit..&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Monitoring Benchmarks:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;All facilities are required to conduct visual and chemical (benchmark) monitoring. This permit, once promulgated, will replace the existing industrial stormwater permit, which expired in 2005.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.calthacompany.com/blog/2010/02/arizona-adeq-draft-industrial-multi.html"&gt;Review a summary of the ADEQ Industrial Stormwater Permit &lt;/a&gt;&lt;br /&gt;&lt;br /&gt;The proposed permit details requirements for 29 different industrial sectors. The requirements described below are proposed for the &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Timber Products Sector (Sector A)&lt;/span&gt;&lt;span style="color:#000000;"&gt;.&lt;/span&gt;&lt;/strong&gt; Sector A covers a fairly broad range of facility types, including log storage or handling areas, mills, producing lumber and wood basic materials, wood preserving, manufacturing finished articles made entirely of wood or related materials, and manufacturing wood buildings or mobile homes. These requirements are &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;in addition to permit requirements that apply to all sectors&lt;/span&gt;&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Inspections:&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;If the facility performs wood surface protection and preservation activities, monthly inspections must include processing areas and treated wood storage areas to assess the effectiveness of practices to eliminate the deposit of treatment chemicals on unprotected soils and eliminate all contact with stormwater discharges.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Industry-Specific Stormwater Controls:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The facility must have secondary containment for all significant materials stored indoor and outdoor, (e.g. arsenic, chromium, zinc, copper, and phenolic solution storage tanks and structures). Facility must also drain containment stormwater for outdoor storage tanks and structures only after inspection demonstrates that no stormwater contact with solutions has occurred.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Potential Pollutant Sources:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;If the operation uses chlorophenolic, creosote, or chromium-copper-arsenic formulations for wood surface protection or preserving, the SWPPP must document 1) areas where contaminated soils, treatment equipment, and stored materials still remain, and 2) the management practices employed to minimize the contact of these materials with stormwater runoff.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Monitoring Benchmarks:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;All facilities are required to conduct visual and chemical (benchmark) monitoring. This permit, once promulgated, will replace the existing industrial stormwater permit, which expired in 2005.&lt;br /&gt;&lt;br /&gt;&lt;a href="http://www.calthacompany.com/blog/2010/02/arizona-adeq-draft-industrial-multi.html"&gt;Review a summary of the ADEQ Industrial Stormwater Permit &lt;/a&gt;&lt;br /&gt;&lt;br /&gt;The proposed permit details requirements for 30 different industrial sectors. The requirements described below are proposed for the &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Steam Electric Generating Facilities (Sector O)&lt;/span&gt;&lt;span style="color:#000000;"&gt;.&lt;/span&gt;&lt;/strong&gt; Sector O covers three primary types of facilities, 1) steam electric power generation using coal, natural gas, oil, nuclear energy, etc., to produce a steam source; 3) dual fuel co-generation facilities; and 3) alternative fuel generating facilities used to produce steam.&lt;br /&gt;&lt;br /&gt;These requirements are &lt;strong&gt;&lt;span style="color:#ff9900;"&gt;in addition to permit requirements that apply to all sectors&lt;/span&gt;&lt;/strong&gt;.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Good Housekeeping Practices:&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The SWPPP must describe and implement procedures to reduce fugitive emissions and control the tracking of coal dust. Sites must implement effective controls to minimize contamination of precipitation or surface runoff from fuel oil and chemical and other material handling areas.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Inspections&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Inspections must include:&lt;br /&gt;a) coal handling areas,&lt;br /&gt;b) delivery vehicles,&lt;br /&gt;c) Fuel unloading areas,&lt;br /&gt;d) areas adjacent to disposal ponds and landfills.&lt;br /&gt;&lt;br /&gt;Monthly inspections must include all residue-hauling (i.e. ash) vehicles for proper covering over the load, adequate gate sealing, and overall integrity of the container body. Dischargers must repair, as soon as practicable, vehicles without load covering or adequate gate sealing, or with leaking containers or beds.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Preventative Maintenance:&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The SWPPP must describe and implement measures that prevent or minimize stormwater from contacting fugitive dust emissions from coal handling areas and to prevent or minimize contamination of stormwater runoff from delivery vehicles carrying significant materials arriving at the facility. The SWPP must have procedures ensuring overall integrity of the body or container and procedures to deal with leakage or spillage from vehicles or containers.&lt;br /&gt;&lt;br /&gt;The SWPPP must also describe and implement measures that prevent or minimize contamination of surface runoff from oil-bearing equipment in switchyard areas and to retard flows and limit the spread of spills from oil-bearing equipment in switchyards, or collecting runoff in perimeter ditches from these areas.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Spills and Leaks:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The SWPPP must describe and implement measures to reduce the potential for an oil or chemical spill, or reference an SPCC plan, and to visually inspect the structural integrity of all above-ground tanks, pipelines, pumps, and related equipment, and conduct any necessary repairs immediately.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Management of Runoff:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;The SWPPP must describe and implement measures that prevent or minimize contamination of surface runoff from areas adjacent to disposal ponds or landfills, and must include procedures to reduce ash residue that may be tracked on to access roads traveled by residue handling vehicles, and reduce ash residue on exit roads leading into and out of residue handling areas.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;SWPPP Contents:&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The SWPPP must identify:&lt;br /&gt;1) scrap yards, and general refuse areas;&lt;br /&gt;2) short- and long-term storage of construction materials, paint equipment, oils, fuels, used and unused solvents, cleaning materials, paint, water treatment chemicals, fertilizer, and pesticides);&lt;br /&gt;3) landfills and construction sites; and&lt;br /&gt;4) stockpile areas (e.g., coal or limestone piles).&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Monitoring Benchmarks:&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;All facilities are required to conduct visual and chemical (benchmark) monitoring. This permit “&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;AZPDES MSGP 2010&lt;/span&gt;&lt;/strong&gt;”, once promulgated, will replace the existing industrial stormwater permit, which expired in 2005. ADEQ anticipates the MSGP to be public noticed sometime during the winter of 2010.&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;The AZPDES MSGP 2010 contains 8 parts and 5 appendices. Parts 1 through 7 describe the requirements that &lt;strong&gt;all operators&lt;/strong&gt; must meet when seeking coverage under this permit. Part 8 describes the &lt;strong&gt;additional sector-specific requirements&lt;/strong&gt; for industrial activities, sub-divided into 30 industry sectors.&lt;br /&gt;&lt;br /&gt;&lt;p&gt;Much of the ADEQ permit is based on the US EPA Multi-Sector General Permit (MSGP 2008) that became effective on Sept. 29, 2008. Some of the Arizona-specific changes from the MSGP 2008 include: &lt;/p&gt;&lt;ul&gt;&lt;li&gt;The NOI must include the well registration number if stormwater associated with industrial activity is discharged to a dry well or an injection well. &lt;/li&gt;&lt;li&gt;Facilities with liquid storage areas for SARA Section 313 water priority chemicals must be operated to minimize discharges of such chemicals. &lt;/li&gt;&lt;li&gt;All facilities or any portion of a facility that is located at or within the 100-year floodplain must be delineated on the site map. &lt;/li&gt;&lt;li&gt;Facilities subject to monitoring and reporting requirements must submit a discharge monitoring report form(s) and other required monitoring information. &lt;/li&gt;&lt;li&gt;The term "significant sources of non-stormwater" includes, but is not limited to, discharges that could cause or contribute to violations of Arizona water quality standards, and discharges that could include releases of oil or hazardous substances in excess of reportable quantities under section 311 of the Clean Water Act (CWA) (See 40 CFR 110.10 and 40 CFR 117.21) or section 102 of CERCLA (See 40 CFR 302.4).&lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;All facilities covered under the permit will need to comply with Parts 1 through 7. Some of the key requirements that all permittees will meet include:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;SWPPP.&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Each site will need to prepare and maintain a stormwater pollution prevention plan (SWPPP). The SWPPP will need to include:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;em&gt;&lt;span style="font-size:85%;"&gt;Good Housekeeping.&lt;br /&gt;Maintenance.&lt;br /&gt;Spill Prevention and Response Procedures.&lt;br /&gt;Erosion and Sediment Controls.&lt;br /&gt;Management of Runoff&lt;br /&gt;Management of Salt Storage Piles or Piles Containing Salt.&lt;br /&gt;Sector Specific Control Measures.&lt;br /&gt;Employee Training.&lt;br /&gt;Elimination of Non-Stormwater Discharges.&lt;br /&gt;Litter, Garbage and Floatable Debris&lt;br /&gt;Dust Generation and Vehicle Tracking of Industrial Materials.&lt;br /&gt;&lt;/span&gt;&lt;/em&gt;&lt;/strong&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Routine Facility Inspection Procedures.&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Every site will conduct routine quarterly inspections of all areas of the facility where industrial&lt;br /&gt;materials or activities are exposed to stormwater with the potential to discharge from the facility, and of all stormwater control measures used to comply with this permit.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Visual Assessment of Stormwater Discharges.&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Every site will also perform two visual assessments during the summer wet season and two during the winter wet season when the facility is discharging. The visual assessment is be made collecting a sample in a clean, clear glass, or plastic container, and examining it in a well-lit area.&lt;br /&gt;&lt;br /&gt;&lt;span style="color:#ff9900;"&gt;&lt;strong&gt;Comprehensive Facility Inspection.&lt;/strong&gt;&lt;br /&gt;&lt;/span&gt;Once each year the qualified person or persons will conduct an annual comprehensive facility inspection (CFSI). The South Dakota Department of Environment &amp;amp; Natural Resources (DENR) issued the revised permit on December 31, 2009; this permit replaced the previous, which had been issued in 2002 and has been expired since 2007. The revised permit makes a number of changes to the stormwater compliance requirements needing to be met at affected construction sites.&lt;br /&gt;&lt;br /&gt;Some of the key requirements include:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Permit&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;ul&gt;&lt;li&gt;NOI must be signed by the owner &lt;/li&gt;&lt;li&gt;SWPPP must be developed before the NOI is submitted &lt;/li&gt;&lt;li&gt;All SWPPPs, inspection reports, or other information must be signed and certified by a signatory official or by a “duly authorized representative” (Signatory authority must identify authorized representative and submit written authorization letter to DENR) &lt;/li&gt;&lt;/ul&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;&lt;/span&gt;&lt;/strong&gt;&lt;p&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Controls &lt;/span&gt;&lt;/strong&gt;&lt;/p&gt;&lt;ul&gt;&lt;li&gt;Controls must be designed to meet 2 inch 24 hour event (2-year, 24-hour storm event) &lt;/li&gt;&lt;li&gt;Sediment basins required if &gt;10 acres disturbed at one time, where possible &lt;/li&gt;&lt;li&gt;Sediment traps or other equivalent controls required if &lt;10&gt; The revised permit has numerous substantive changes compared to the previous industrial stormwater permit. Some highlights of these changes include:&lt;br /&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Stormwater Pollution Prevention Plan (SWPPP) Requirements&lt;/span&gt;&lt;br /&gt;&lt;/strong&gt;&lt;br /&gt;Mandatory BMPs must be implemented no later than July 1, 2010. The facility may omit individual BMPs if site conditions render the BMP unnecessary, infeasible, or the Permittee provides alternative and equally effective BMPs; and justifies the omission in the SWPPP. The mandatory BMPs include:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;Operational Source Control BMPs:&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;&lt;ul&gt;&lt;li&gt;Vacuum paved surfaces with a vacuum sweeper once each quarter. &lt;/li&gt;&lt;li&gt;Minimize stormwater contamination from dust. Inspect and maintain bag houses monthly. &lt;/li&gt;&lt;li&gt;Keep all dumpsters under cover or keep dumpster lid closed when not in use. &lt;/li&gt;&lt;li&gt;Clean catch basins when at capacity. &lt;/li&gt;&lt;li&gt;Inspect all equipment and vehicles for leaking fluids. Take leaking equipment and vehicles out of service or prevent leaks until repaired. &lt;/li&gt;&lt;li&gt;Store all chemical liquids, fluids, and petroleum products on an impervious surface with containment that is capable of containing 10% of the total enclosed tank volume or 110% of the volume contained in the largest tank, whichever is greater. &lt;/li&gt;&lt;li&gt;Prevent precipitation from accumulating in containment areas. &lt;/li&gt;&lt;li&gt;Locate spill kits within 25 feet of all stationary fueling stations, fuel transfer stations, and mobile fueling units. &lt;/li&gt;&lt;li&gt;Facility personnel can not lock shut-off fueling nozzles in the open position, or “top-off” tanks being refueled. &lt;/li&gt;&lt;li&gt;During fueling, facility personnel must block, plug or cover storm drains that receive runoff from areas where fueling. &lt;/li&gt;&lt;li&gt;Use drip pans or equivalent containment measures during all petroleum transfer operations. &lt;/li&gt;&lt;li&gt;Maintain a spill log that documents chemical and petroleum spills.&lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;&lt;strong&gt;Structural Source Control BMPs: &lt;/strong&gt;&lt;br /&gt;&lt;ul&gt;&lt;li&gt;Use grading, berming, or curbing to prevent runoff of contaminated stormwater flows and divert run-on away from manufacturing, processing, and material storage areas. &lt;/li&gt;&lt;li&gt;Perform all cleaning operations indoors, under cover, or in bermed areas that prevent stormwater runoff and run-on and capture any overspray. Drain wash water to a collection system for further treatment or storage.&lt;br /&gt;&lt;/li&gt;&lt;/ul&gt;&lt;p&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;SWPPP Signature/Certification&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;The Permittee must sign and certify the SWPPP and any revisions.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Benchmark Monitoring / Sampling&lt;/span&gt;&lt;/strong&gt; &lt;/p&gt;&lt;p&gt;Facility must sample each distinct point of discharge off-site each calendar quarter; except “substantially identical outfalls”. Sampling must occur within the first 12 hours of stormwater discharge or as soon as practicable after the first 12 hours. Facilies must sample the stormwater discharge from the first fall storm event, after October 1st.  “Consistent attainment” requires that four consecutive quarterly samples be equal to or less than the benchmark value; or for pH, within the range of 5.0 – 9.0.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Benchmarks and Effluent Limitations&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;a href="http://www.calthacompany.com/WQ_standards/2010/01/revised-washington-benchmarks-for.html"&gt;Click here to review new stormwater benchmark concentrations&lt;/a&gt;&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Discharges to 303(d)-Listed Waters&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Numeric effluent limits now apply to facilities with discharges to 303(d)-listed impaired waterbodies (Category 5). &lt;/p&gt;&lt;p&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Inspections&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;Qualified personnel conduct and document visual inspections of the site monthly. Dry season and annual comprehensive inspection eliminated.&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Corrective Actions&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;&lt;br /&gt;Permittees that exceed benchmark value (for a single parameter) for any two quarters during a calendar year complete a Level 2 Corrective Action (Structural Source Control BMPs). Permittees that exceed benchmark value (for a single parameter) for any three quarters during a calendar year complete a Level 3 Corrective Action (Treatment BMPs).&lt;br /&gt;&lt;br /&gt;Facilities must revise their SWPPP and complete installation by September 30th the following year. All corrective actions must be documented in Annual Report. These rules streamline the assessment and approval process for the reuse of dredged sediments, especially if not intended to be disposed of in a landfill.&lt;br /&gt;&lt;br /&gt;WDNR rules establish management standards, risk assessment procedures and “ceiling” contaminant concentrations for sediments. The sediment contaminants regulated under NR 528 include several heavy metals (arsenic, cadmium, chromium, lead), pH and electrical conductivity.&lt;br /&gt;&lt;br /&gt;The end-uses considered under the rule include:&lt;br /&gt;&lt;br /&gt;&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Disposal in licensed landfill,&lt;br /&gt;General fill,&lt;br /&gt;Confined geotechnical fill,&lt;br /&gt;Landspreading,&lt;br /&gt;Dedicated sediment management sites, and&lt;br /&gt;Small quantity, course grained sediment management&lt;br /&gt;&lt;/span&gt;&lt;/strong&gt;&lt;br /&gt;NR 528 defines the level of risk assessment, acceptance criteria and specific management practices required for the different end-uses. style="color:#ff9900;"&gt;Energy Independence and Security Act of 2007&lt;/span&gt;&lt;/strong&gt; (EISA), federal agencies have new requirements to reduce stormwater runoff from federal development and redevelopment projects to protect water resources. Federal agencies can comply using a variety of stormwater management practices often referred to as "green infrastructure" or "low impact development" practices, including for example, reducing impervious surfaces, using vegetative practices, porous pavements, cisterns and green roofs.&lt;br /&gt;&lt;br /&gt;US EPA has recently issued guidance ("&lt;strong&gt;&lt;span style="color:#ff9900;"&gt;Technical Guidance on Implementing the Stormwater Runoff Requirements for Federal Projects under Section 438 of the Energy Independence and Security Act&lt;/span&gt;&lt;/strong&gt;") to assist federal agencies in minimizing the impact of federal development projects on nearby water bodies. The guidance is being issued in response to a change in law and an Executive Order signed by President Obama, which calls upon all federal agencies to lead by example to address a wide range of environmental issues, including stormwater runoff.&lt;br /&gt;&lt;br /&gt;The purpose of the guidance document is to provide technical guidance and background information to assist federal agencies in implementing EISA Section 438. Each agency or department is responsible for ensuring compliance with EISA Section 438. According to EPA, the extension is needed to ensure Agency compliance with a court order requiring promulgation of effluent limitations guidelines (ELG) and new source performance standards (NSPS) for the construction and development (C&amp;amp;D) point source category.&lt;br /&gt;&lt;br /&gt;The 2008 CGP provides coverage for discharges from construction sites in areas not addressed by an approved state national pollutant discharge elimination system (NPDES) program. EPA Regions 1, 2, 3, 5, 6, 7, 8, 9, and 10 issued the 2008 CGP to replace the expired 2003 CGP for operators of new and unpermitted ongoing construction projects.  The current 2008 CGP expires on June 30, 2010.&lt;br /&gt;&lt;br /&gt;EPA is proposing to extend coverage of the CGP to June 30, 2011. This would give EPA approximately the same time period—18 months—that the Agency required to issue the 2003 CGP.
